The Rules, Terms and Conditions

 

1.                    The Winchester Treasure is published on behalf of its author by Dream Fulfilment Ltd of 26 York Street London W1U 6PZ

2.                    "We" means Dream Fulfilment Ltd (DF) and "us", "our" and 'ours" are to be construed accordingly

3.                    Where applicable the singular includes the plural and vice versa, and any gender includes all other genders

4.                    The website referred to in these rules shall be either www.winchestertreasure.com or www.winchestertreasure.co.uk and these shall be interchangeable.

 

 

1.        These rules apply to the competition within the publication ‘The Winchester Treasure’ (TWT). By the act of participating in the competition whether by submitting an entry, purchasing the publication or otherwise, all participants agree to be bound by, and to abide by, these rules.

2.        There are 3 levels to the competition contained in TWT. These are the Bronze, Silver and Gold levels.

3.        All information necessary to provide solutions at all three levels is freely available or may be contained within the publication.

4.        The competition does not require entrants to visit Winchester. Entrants are expressly forbidden to trespass, cause nuisance or damage or otherwise act in any way illegally whilst engaged in solving the clues or answering questions and DF accepts no responsibility for any such actions.

5.        Each copy of the publication, whether in electronic or hard copy, will have a unique identifying number that must be quoted when entering any level of the competition. Entries without a valid number will be disqualified.

6.        Each level can be entered separately or the entry for the Bronze and Silver levels can be combined.

7.        It is not necessary to have entered the Bronze level to enter the Silver level and it is not necessary to have entered the Bronze or Silver level before entering the Gold level.

8.        There is no charge for entering the Gold level.

9.        There is an extra charge for entering the Bronze and/or Silver levels. This extra charge, less identifiable expenses, will be donated to charity. The names of the recipient charity or charities will be found on the website. The only prizes at Bronze and Silver levels are certificates of completion.

10.     At the Bronze and Silver levels the entrant will be required to answer the questions found throughout the publication. All answers for each level must be correct. If an entrant submits the correct answers for either level and pays the extra charge DF will issue a certificate to the named entrant posted to the address supplied by the entrant.

11.     At the Gold level the entrant will be required to identify exactly what the treasure is and where it was hidden. The prize for the Gold level is the treasure.

12.     Submissions for all levels must be made by supplying the appropriate answers to the questions on the submission pages of the website. No submissions will be accepted by any other means.

13.     DF will not be responsible for loss or delays caused by postal services or for breaks in internet transmission or for unavailability of the website for any reason at any time.

14.     The competition will run until midnight 31st December 2007. (GMT)

15.     Entries at Bronze and Silver level will be acknowledged by email and, if checked to be correct, certificates will be posted as soon as possible thereafter. If the entry is incorrect the entrant will be allowed 2 further attempts without further charge. Subsequent entries will be regarded as new entries and will be charged for as per rule 5. No refunds will be given for incorrect entries.

16.     Entries at Gold level will be acknowledged by email but the entrant will not be told if he is correct until the competition closes. Only those entrants with completely correct answers will be contacted at that time.

17.     An entrant may submit more than one entry for the Gold level but only the latest entry will be accepted. Earlier entries from the entrant will be discarded and will not be eligible for the competition.

18.     If there is more than one correct entry at the Gold level received before the close of the competition then a further ‘tie-break’ competition will be set for those correct entrants.

19.     If there is no correct entry at the Gold level by the close of the competition then the competition will remain open until a correct entry is received. If this is the case the first correct entry will win the treasure.

20.     At DF’s discretion additional clues may be published from time to time on the website.

21.     DF’s decision as to the winning entry, and all other matters affecting the competition, is final and no correspondence as to such matters will be entered into.

22.     All entrants must submit their entries under their true legal name and address. Any entries found to have been submitted under a false or assumed name or alias will be disqualified. The winner will be disqualified and forfeit the treasure if he is found to have participated under a false or assumed name or alias.

23.     Only one person may win the treasure. No entries made by, or on behalf of more than one person will be accepted, although the winner may share the treasure with others as the winner may choose or agree with such others. DF shall not be affected by notice of any such agreement, and will give the treasure to the winner.

24.     DF and its agents, associated companies and organisations, and consultants, their employees and members of their families (whether married or not) and households are ineligible to participate in the Gold level competition. Appropriate legal and disciplinary action will be taken against any such person found to have provided information that is, or may be, helpful to the solution of the competition and that was acquired by such person in the course of or by reason of his holding such position or being in such relationship or household.

25.     It shall be a breach of the rules of the competition to receive from any such person any information that is, or may be, helpful to the solution of the Gold level competition that was acquired by such person in the course of or by reason of his holding such position or being in such relationship or household.

26.     At the Gold level only, following receipt by DF of an entry or entries that DF considers to be correct, a period of 28 days from the close of the competition or from the receipt of the first correct entry, whichever shall be later, shall be allowed for DF to verify that the winner has abided by the rules of the competition. In the event that the winner has not abided by the rules of the competition, his winning entry shall be disqualified from the competition, and he shall forfeit the treasure, and he shall no longer be permitted to participate in the competition. DF will give no notification of such disqualification to any person other than that entrant, and the competition will continue as though no winning entry had been received.

27.     In the event that DF does verify that the Gold level winner has abided by the rules of the competition, DF will contact the winner and issue an announcement on the website that the treasure has been won and that the competition is over. At that time DF will also publish the solution to the puzzle on the website. The solution will remain there for a period of at least 6 months.

28.     The winner will be responsible for any taxes or duties on the value of the treasure should any be incurred by him as a consequence of winning the treasure.

29.     Entrants understand and accept that DF may arrange a public presentation at which the winner will be presented as the winner of the competition.

30.     DF will publicize the public presentation as it sees fit. In particular, DF will publicize the name of the winner.

31.     Although DF will try to arrange the public presentation for a date and time, and at a venue, that is convenient to the winner, entrants agree to attend such public presentation, should they be judged to be the winner, whenever and wherever the public presentation may be held. Entrants understand and accept that the winner will be responsible for all the costs and expenses of all travel to, and, should it be necessary; accommodation in the vicinity of, the venue chosen by DF for the public presentation of the treasure.

32.     The responsibility for conducting all aspects of the competition and for providing the treasure is that of DF. No responsibility for those things shall attach to any other person or body.

33.     All entrants agree to indemnify and hold forever harmless DF, its affiliated companies and the officers and employees of all and any of them against and from any injury, accident or cause of action arising from or in connection with participation in the competition or receipt of the treasure.

34.     Any personal data relating to entrants will be used solely in accordance with current English data protection legislation and, save to the extent indicated above, will not be disclosed to a third party without the entrant's prior consent.

35.     Any disputes arising from or out of these rules, the competition or any entrant's participation in the competition will be governed by the Law of England and Wales, and shall be referred for determination to a single arbitrator to be appointed jointly and by agreement between the parties in dispute.

36.     In the event that the parties in dispute are unable to reach agreement as to the identity of the said arbitrator within 21 days of one party giving the other formal notification of a desire to refer the matter to such an arbitrator, then either party may invite the President of the Law Society of England and Wales for the time being to appoint the arbitrator, and the arbitrator shall be the person so appointed.

37.     The parties shall submit their written cases to the arbitrator within 21 days after his appointment, and the arbitrator shall give his decision in writing within 42 days of his appointment, or, if earlier, within 21 days of receipt of all the written cases of the parties to the dispute. The provisions of Arbitration Acts for the time being in force shall govern such arbitration.

38.     All notices and documents required to be sent under rules 35 to 37 inclusive shall be given in writing, and may only be delivered by Recorded Delivery Post to the address of the intended recipient most recently given by the intended recipient to the sender or by e‑mail to the e‑mail address of the intended recipient most recently given by the intended recipient to the sender.

39.     These rules are subject to change. The latest version of the rules may be found on the website and the competition will always be deemed to be held in accordance with the latest rules displayed there. Ignorance of the latest rules will not nullify them.
